GENERAL TERMS AND CONDITIONS OF SALE – SARL ECOLODGES DOMAINE DE PUYFERRAT

ARTICLE 1: APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

These General Terms and Conditions of Sale (GTCS) apply to the reservation made by the Customer. These GTCS are available to Customers on our website. Any reservation therefore implies the Customer’s full and unconditional acceptance of these terms.

ARTICLE 2: BOOKING ARRANGEMENTS

For all Customers, the reserved Ecolodges are available from 4:00 p.m. on the day of arrival. They must be vacated no later than 11:00 a.m. on the day of departure. Any delay beyond this time may result in the invoicing of an additional night at the published public rate.

1/ Reservations may be made directly with SARL ECOLODGES Domaine de Puyferrat, by post, email, telephone, or via the website. All reservation methods are subject to confirmation by SARL ECOLODGES Domaine de Puyferrat. If the reservation is made through one of our partners’ websites or directly with one of our partners, no confirmation is sent directly to the Customer by SARL ECOLODGES Domaine de Puyferrat.

2/ For the reservation to be considered definitive, whether last-minute or not, the Customer must pay a deposit equal to 50% of the total stay amount (excluding tourist tax). The balance must be paid no later than the day of arrival, except for reservations made through our partners.

3/ If the reservation is made directly through one of our partners, the partner shall send SARL ECOLODGES Domaine de Puyferrat written confirmation of the reservation with the Customer’s details, without transmitting any bank card information.

4/ For Ecolodge reservations made outside the website booking system, a specific contract is drawn up by SARL ECOLODGES Domaine de Puyferrat for the Customer.

ARTICLE 3: CANCELLATION

As billing is based on the services ordered for the entire stay, the Customer is invited to pay particular attention to the cancellation conditions defined below.

1/ The following are considered cancellations:

– a change of reservation dates,

– failure to pay contractual deposits,

– oral or written notice of non-arrival for personal reasons,

– non-arrival without notice,

– failure to comply with the rules of SARL ECOLODGES Domaine de Puyferrat.

2/ Any cancellation of all or part of the initial reservation must be accepted in writing by SARL ECOLODGES Domaine de Puyferrat, which may refuse any request to modify services without providing justification. In the absence of written acceptance, the reservation remains unchanged, and SARL ECOLODGES Domaine de Puyferrat may not be held liable for the payment of any compensation.

3/ Any stay reserved or commenced at SARL ECOLODGES Domaine de Puyferrat is payable in full in accordance with the reservation made by the Customer. No reduction or refund will be granted in the event of non-arrival or early departure at the Customer’s initiative, whatever the reason (except in the exclusions below).

4/ Cancellation deadlines:

– 90 days or more before arrival: all sums paid are refunded to the Customer

– Between 89 and 60 days before arrival: 50% of the total stay amount is refunded

– Between 59 days and the day of arrival or no-show: 100% of the stay amount is retained by SARL ECOLODGES Domaine de Puyferrat

5/ Exclusions from the application of cancellation conditions:

– Death of a family member: a death certificate and proof of relationship must be provided

– Hospitalization of the Customer or a family member: a hospital admission certificate stating the reason must be provided

– Major incident at the Customer’s primary residence (fire, destruction, burglary): supporting documents must be provided (insurance, police report, etc.)

ARTICLE 4: RELOCATION

In the event of unavailability of the establishment, force majeure, technical issues, or for any other reason, the establishment reserves the right to accommodate Customers wholly or partially in accommodation of an equivalent category offering similar services. SARL ECOLODGES Domaine de Puyferrat may not be held liable for the payment of any additional compensation.

ARTICLE 5: PRICES

Prices are expressed in euros. Applicable prices are those in force on the day the reservation is made. Prices are increased by the tourist tax. They may be modified in the event of legislative and/or regulatory changes likely to result in price variations, such as changes in the applicable VAT rate or the introduction of new taxes. The applicable VAT rate is that in force on the date of invoicing.

Organic homemade breakfasts are not included in the base price; they are optional and priced at €25 per person.

Final cleaning is included in the price; however, the Customer is requested to leave the lodge in a minimum state of cleanliness.

An intermediate cleaning service is included halfway through the stay for any reservation of 7 nights or more, including towel replacement and waste removal. For ecological reasons, Customers are requested to sort waste selectively.

Bed linen is changed every 7 days for ecological reasons. In the event of stained linen, the Customer must report it immediately.

ARTICLE 6: PAYMENT TERMS

1/ Deposit

The deposit must be paid by bank transfer to the account of SARL ECOLODGES Domaine de Puyferrat or by credit card via a payment link sent through the establishment’s website.

2/ Balance

The balance of the reservation and the tourist tax must be paid no later than the day of arrival, by bank transfer to the account of SARL ECOLODGES Domaine de Puyferrat or by credit card via a payment link or through the establishment’s website.

3/ Security Deposit

A security deposit is required for all reservations.

It must be paid in cash or by bank transfer to the bank account of SARL ECOLODGES – Domaine de Puyferrat.

The amount of the security deposit is set as follows:

– €400 for the LAKOU accommodation

– €350 per suite for the KABURA and OKO accommodations

– €700 for the full private use of KABURA or OKO

The security deposit is intended to cover any damage, deterioration, or breaches noted during the check-out inspection. It is refunded after departure, provided no issues are identified.

4/ Failure to Pay

In the event of non-payment by the contractual due date, late payment penalties shall be due from the day following the invoice due date at an annual rate of 15%, applied to the total amount including VAT. In addition, a fixed indemnity of €40 excluding VAT per claim shall be payable from the day following the invoice due date, to which may be added a supplementary indemnity covering all recovery costs incurred in the event of legal recovery proceedings. Any payment made more than 60 days after the invoice issue date is legally considered an abusive practice and subject to criminal penalties. Furthermore, any failure to pay by the contractual due date shall render immediately payable all outstanding amounts owed by the Customer and shall result in a modification of payment terms, requiring advance payment for any new reservation request until full settlement of outstanding amounts.

ARTICLE 7: TRANSPORT

SARL ECOLODGES Domaine de Puyferrat does not provide any transport services and cannot be held liable for any transport-related issues affecting Customers (delays, cancellations, etc.).

ARTICLE 8: BREACHES, DAMAGE CAUSED BY THE CUSTOMER

The Customer agrees to use the Ecolodge responsibly and in a reasonable manner. Any behavior contrary to good morals or public order will entitle SARL ECOLODGES Domaine de Puyferrat to require the Customer to leave the establishment without compensation and/or without refund if payment has already been made.

1/ Security Deposit for Ecolodges

Upon taking possession, a security deposit is required: €350 for the LAKOU Ecolodge, €300 for a suite in the OKO and KABURA Ecolodges, and €600 for full OKO and KABURA Ecolodges. This deposit covers damage that may be caused to the rented property and/or its furnishings, as well as clear failures in maintenance. At the end of the stay, deposits are refunded after deduction for any damage, breaches, or additional cleaning costs.

On the day of arrival, it is the Customer’s responsibility to carry out the inventory using the document provided by SARL ECOLODGES Domaine de Puyferrat and to report any anomalies to reception by 11:00 a.m. the day following arrival.

On the day of departure, a joint inventory is conducted, and deposits are refunded immediately if no damage or breaches are identified.

2/ Additional Persons

The Customer agrees not to bring additional persons without the express authorization of SARL ECOLODGES Domaine de Puyferrat and not to sublet the accommodation. In such cases, SARL ECOLODGES Domaine de Puyferrat reserves the right to refuse accommodation and retain the deposit.

3/ Access to the Pool and Green Areas

The Customer agrees to comply with the Internal Regulations governing the use of these facilities. The use of these facilities by minors is under the sole responsibility of parents or legal guardians.

4/ Children – Safety Conditions

For safety reasons related to the presence of unsecured water features, the Ecolodges of Domaine de Puyferrat are not suitable for children under the age of 10.

Any reservation involving children under the age of 10 may be refused or cancelled without SARL ECOLODGES Domaine de Puyferrat being held liable.

ARTICLE 9: INSURANCE – DAMAGE – BREAKAGE – THEFT

The Customer certifies having taken out civil liability insurance to cover any damage caused by themselves during their stay.

The Customer is responsible for safeguarding their personal belongings and equipment. They are invited to take out specific insurance in the case of valuable or bulky items, as the establishment cannot be held liable for damage or theft.

The Customer is responsible for all damage caused by themselves and undertakes to bear the costs of restoring the premises. Under no circumstances may the establishment be held liable for any damage, in particular fire or theft, affecting property brought by the Customer.

Any parcels delivered to SARL ECOLODGES Domaine de Puyferrat before or during the stay may be accepted, but the establishment cannot be held liable for any incident, damage, incorrect quantity, damaged parcels, or delivery issues. In case of a problem, the Customer must contact the supplier or carrier directly.

The Customer and their insurers waive any recourse against SARL ECOLODGES Domaine de Puyferrat, its staff, and insurers for any direct or indirect damage resulting from total or partial destruction of property, furnishings, equipment, valuables, goods, or loss of use of the premises.

ARTICLE 10: ANIMALS

Animals are not permitted at SARL ECOLODGES Domaine de Puyferrat. Any Customer arriving with an animal will be refused access to the establishment or Ecolodges, and the cancellation conditions of Article 3 will apply.

ARTICLE 11: SMOKING

Smoking is strictly prohibited in the Ecolodges in accordance with the law of 2 January 2008.

ARTICLE 12: EVENTS

It is strictly forbidden to organize parties on the Ecolodges site, which follows an eco-responsible and slow tourism approach.

ARTICLE 13: LIABILITY

SARL ECOLODGES Domaine de Puyferrat shall not be held liable in the event of any change in the structure of the establishment, such as transfer or closure. Photos displayed on the website are non-contractual. Despite best efforts to ensure accurate representations of accommodation services, variations may occur, particularly due to furniture changes or renovations. The same applies to any additional services offered. The Customer may not claim compensation on this basis. SARL ECOLODGES Domaine de Puyferrat shall not be liable for any indirect damage, including loss of business, third-party actions, Customer actions, or actions of its partners.

ARTICLE 14: FORCE MAJEURE

Obligations under these terms shall not apply or shall be suspended if performance becomes impossible due to force majeure events, including but not limited to acts of public authority, hostilities, natural disasters, fire, flooding, or strikes without notice. The party invoking force majeure must immediately notify the other party of the beginning and end of such event.

ARTICLE 15: AMENDMENTS

These GTCS may be amended at any time. In such cases, SARL ECOLODGES Domaine de Puyferrat shall inform the Customer prior to the commencement of services. The new version shall then apply to relations between the parties.

ARTICLE 16: PARTIAL INVALIDITY

The invalidity of one or more articles of these GTCS shall not result in the invalidity of the entire document. All other provisions shall remain applicable.

ARTICLE 17: CLAIMS AND DISPUTES

In the event of a dispute or claim regarding part of an invoice, the Customer must pay the undisputed portion without delay and notify the establishment in writing of the reasons and amount of the dispute within 7 days from the end of the stay. After this period, services and invoicing are deemed accepted and may not be contested. In the absence of an amicable settlement, the competent courts shall be those of the registered office of the company operating the establishment.

ARTICLE 18: APPLICABLE LAW

These terms are governed by French law.

ARTICLE 19: DOMICILE FOR SERVICE

All written communications between the parties must be sent to SARL ECOLODGES Domaine de Puyferrat at its postal or electronic address, and to the Customer at the address provided in the reservation.

ARTICLE 20: ADDITIONAL SERVICES

Services offered by SARL ECOLODGES Domaine de Puyferrat and provided by third-party service providers are governed by the sales conditions of the relevant providers. SARL ECOLODGES Domaine de Puyferrat shall not be held liable or required to pay any compensation in the event of failure, cancellation, or modification of such services.
